The slogan “no representation, no taxation” used to suggest that payment of taxes by people who could not decide on the expenditure of that money was unjust. The opposite is the case now: Trump is spending money without the support of Congress, the body that represents people and is thus doing the exact opposite of what the phrase suggests.

Trump and the Republican corner expect the Democrats to vote for a continuing resolution, a short-term spending bill to keep the government funded at last year’s levels, called a continuing resolution. The Democrats have no objection to this—but only when Trump views it as a condition to renewing the healthcare insurance subsidies that were made during the pandemic using Obamacare deductions.
At present, it does seem that the Democrats are having their way. They do not have the presidency, the Senate or the House; however, public opinion is starting to swing their way. Many in the Republican party are being disgruntled by the increase in health insurance premiums. Even Marjorie Taylor Greene, one of the most fervent supporters of Trump, has declared her own party responsible for this. Surveys indicate that a majority of Americans share her opinion.
Thus, at first sight, it appears that the Democrats have a chance of winning this clash.
But that telling is already dated. It does not consider the Trump government’s typical behaviour of hindering or re-routing funds that Congress has already appropriated — a practice that is unconstitutional. According to Article 1, it is Congress alone that determines how federal funds are spent, not the president.
Reports indicate that the administration has blocked approximately $27 billion which had been earmarked for districts that lean Democratic — a strategy that some experts refer to as “ideological targeting.” It means that they are using federal money to hit back at political opponents, which is against the law.
Even if the Democrats come out smiling with the new Obamacare subsidies in hand, there is no certainty that the Trump administration would actually hand over the cash. They have already demonstrated their willingness to disobey the law. Moreover, congressional Republican leaders have claimed that they may try to use legislative loopholes, which only need a simple majority approval, to reclaim the funds later.
Thus, the issue has transcended Obamacare subsidies. The Democrats are waging a battle to prevent Trump from assuming power over federal funds in such a manner that it could lead to his being unaccountable — in other words, acting like a king.
And now, new information has come that escalates the matter even further. The president is said to have transferred funds from one government account to another — more precisely, from the account of research and development to the account of military pay. This may seem like merely a bookkeeping operation, but in fact, it is a serious breach of the Constitution. Article 1, Section 9, Clause 7 plainly states that no expenditure of money is allowed without Congressional approval for that exact purpose.
The experts opine this constitutes a breach of the Antideficiency Act as well, which makes it a federal offense for anyone in the government to use funds that have not been authorized by Congress. So, technically, this could be considered embezzlement in a legal sense.
To sum up, Trump’s recent move is built on earlier illegal actions. First, he blocked the release of funds (that is called impoundment). Now, he is diverting the money for unauthorized purposes (that is called misappropriation). Both are very serious abuses of power, and if Trump is not stopped, he is likely to keep pushing those limits even further.
Typically, richer “blue” states end up transferring more tax dollars to the federal government than they receive, the difference being used for the benefit of poorer “red” states. However, if such a president abuses public money as his personal account, the system could be very much exploitative—almost colonial. Cities that did not vote for him might suffer financially, treated as territories of the union rather than equal parts of it. It is one of the potential yet frightening outcomes of neglecting the “taxation with representation” principle when rulers become unaccountable.
So what position does that place the Democrats in? They need to confront two hard realities.
Firstly, they cannot come to terms with Trump without being implicated in the corruption anyway.
Secondly, they are the only faction remaining that can make and enforce such a decision. Trump will not investigate or punish himself, and the Republican Party seems to be quite content with turning a blind eye.
Pursuing a lawsuit may be one of the options, but that would be quite challenging nonetheless. The courts require that plaintiffs prove they have been directly harmed — a legal benchmark known as “standing” — before they will even entertain the case. And with a Supreme Court that is very much conservative, it is unclear how far such cases would go.
If the courts and law enforcement do not act, the only other way left is political — true repercussions must orbit the Capitol Hill and people of the U.S. in the form of Congress and the A.C. as the consequence. That’s what Representative Alexandria Ocasio-Cortez is saying, and in a roundabout way she’s right — only the Democrats can be that punishment.
Senate Majority Leader John Thune has made an indirect but telling statement that the Republican side has jitters. He referred to the recent “No King’s” demonstration, which is indicative of the fact that the public is not completely indifferent to the issue. If the protest gets larger, it could give a reminder to the Americans that it is not merely about difference of opinions on policies — it is about the very nature of the country whether it remains democratic or goes back to one-man rule.
What is really at stake here is the struggle for power, the question of accountability, and the position of equality. The United States was established upon the very idea that all people are made equal — and that no one, not even a president, is allowed to rule like a monarch.
